Terms and Conditions for Online Ticket Sales

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before purchasing tickets through our website ("the Service") operated by Haymans Inc. ("us", "we", or “our”).

  1. Agreement to Terms

    By accessing or using the Service and by clicking the “Terms Of Service” button, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you may not access this Service.

    Our website is a platform that retails tickets for internally Promoted events by Haymans Inc. as well as by third party Promoters (“Promoter”) that are hosting the event for which you have purchased tickets or services as described.

    1. For events promoted by Haymans Inc.: Events promoted by Haymans Inc will be subject to the following rules and regulations for all ticket holders of the event purchased through this website.
    2. For Third Party Event Promoters or Service Providers: Events are controlled by the third party promoters. Haymans Inc. acts only as a ticket selling agent of the third party Promoter where they have chosen to use our system to issue tickets. All aspects of the event itself are controlled strictly by the Promoter or other third parties. Haymans Inc. does not set ticket prices, the time or date of the event, the content of the event, the nature of the performance, type or arrangement of seating, availability of medical, security or other facilities, parking, access, transportation or any other aspect. Further, third party Promoters set their own rules and regulations for attendance at events, including security policies, search policies, alcoholic beverage policies, ejection policies, refund, cancellation and rescheduling policies and the like. If their rules and regulations are different than ours stated below they will display them during the purchase process. By purchasing a ticket through Haymans Inc. you agree that Haymans Inc. will have no liability for any such policies or activities on behalf of the third party Promoters or any third party and that any complaints you may have with regard to the event or its cancellation or rescheduling, its content or any other aspect of the event will be directed solely to the Promoter and NOT to Haymans Inc. and that Haymans Inc. will not be liable for any such complaints you may have. By purchasing a ticket through our service you acknowledge and agree that your purchase of the ticket and use of the ticket will be subject to those rules and regulations of the Promoter.

  2. Ticket Purchase

    1. Eligibility: You must be at least 18 years old to purchase tickets through our Service.
    2. Currency: Unless stated otherwise the currency we show you is in Barbados Dollars, BD$.
    3. Ticket Sales are Final: You have no right to redeem or cancel a ticket for cash unless the event is cancelled / postponed or changes materially.
    4. Description of Sale: You are purchasing a ticket through our website to allow you access to the stated event or service as described when purchasing. The event will be clearly displayed on the ticket.
    5. Prices and Other Charges: Ticket prices and number of seats are set by us for internal events or by Promotors and Service providers where we have no control over ticket prices or number of seats or the like.
    6. Accuracy: You agree to provide accurate and complete information when purchasing tickets. We are not responsible for any errors in the information provided. Please contact us immediately if there is a mistake.
    7. Payment: All payments are processed securely through our chosen payment processor. By providing payment information, you authorize us to charge the specified amount for your ticket purchase.
    8. Confirmation: On successful completion of your ticket purchase, you will receive a confirmation email containing your ticket details. It is your responsibility to ensure that the email address provided is accurate and accessible.
    9. Delivery / Fulfillment: On purchasing your ticket, we will email you an electronic version as well as a printable PDF file. Either may be presented for entry to the event.

  3. Ticket Usage

    1. Ticket Validity: Your ticket is only valid for the event specified and cannot be transferred, exchanged, or refunded unless otherwise stated in our Refund Policy.
    2. Entry: You must produce a valid Ticket to gain access to an Event and you must keep possession of such Ticket at all times during the Event.  Your Ticket may be invalidated if any part of it is removed, altered or defaced.
    3. Identification: You may be required to present a valid form of identification along with your ticket for entry to the event. Please have it available and ready to present if requested. Failure to provide valid identification may result in denied entry.
    4. For Seated Events: You only have the right to a seat at the Event of a value corresponding to the price paid to for the Ticket. We reserve the right to provide alternative seats at the Event to those originally purchased. Where only seats of a lesser value are available, You will be offered the choice of accepting either (a) the lesser value seats available, or (b) a refund of the price paid for Your Ticket.
    5. Lost tickets: We will not be responsible for any Ticket that is lost, stolen or destroyed.
    6. Reissue of tickets: We may issue duplicate Tickets in our sole discretion.  If we issue a duplicate Ticket, we may charge a reasonable administration fee.
    7. Prohibited Conduct: You agree to abide by all rules and regulations set forth by the event Promoter. We reserve the right to refuse entry or eject any individual who engages in disruptive or prohibited conduct.
    8. Exit & Re-Entry: You may only leave and then re-enter the Venue during an Event at the discretion of the Venue.  Otherwise there shall be no re-admissions or pass-outs of any kind.  Depending on the type of Event, every effort to admit latecomers will be made at a suitable break in the Event, but admission for latecomers cannot always be guaranteed.
    9. Marketing: You shall not bring into the Venue or display or distribute at the Event any sponsorship, promotional or marketing materials.
    10. Searches: By purchasing a ticket you automatically give your consent to searches and you waive any claims that may arise as a result of any such search. If you attempt to attend the event and refuse to allow yourself to be searched, the Promoter may deny you entry to the event without refund or other compensation. Similarly, if during a search, prohibited materials such as alcohol, weapons, drugs, recording devices, etc., are found, the Promoter or venue may refuse you admittance without refund or may confiscate such prohibited materials.
    11. Smoking: Smoking within the Venue is strictly prohibited.  We reserve the right, without refund, to eject any person found smoking in the Venue.

  4. Cancellations and Refunds

    Occasionally, events are canceled, postponed or changed by Haymans Inc., Event Promoters and/or Service providers.

    1. Tickets cannot be exchanged or refunded unless the performance is cancelled, rescheduled or where there is a material change to the Event. A ‘material’ change is a change which, in our reasonable opinion, makes the Event materially different to the Event that purchasers of the Ticket, taken generally, could reasonably expect. Please note that the following are not deemed to be “material” changes: the use of understudies in theatre performances; adverse weather conditions; changes of any supporting act; changes to individual members of a band; changes to the line-up of any multi-performer event (such as a festival); curtailment of the event where the majority of an event is performed in full; and delays to the starting of the performance of an event.
    2. It is Your responsibility to ascertain whether an Event has been cancelled or re-scheduled and the date and time of any re-scheduled Event.  Where an Event is cancelled or re-scheduled, we will use reasonable endeavours to notify You using the details You provided at the time of ordering.  We do not guarantee that You will be informed of such cancellation before the date of the Event. It is also Your responsibility to inform the point of sale from where You bought the Ticket of any change to the contact address, telephone number or email address You provided at the time of purchase.
    3. Where an Event is cancelled, rescheduled (and You notify us within the timeframe specified that You cannot or do not wish to attend the rescheduled event), or where there is a material change to the programme of the Event, You will be entitled to a refund in accordance with Condition 4.f.  If not specified, a timeframe for requesting a refund, the deadline by default will be 48 hours before the date of the rescheduled event. Failure to notify the Agent by the applicable deadline that you are unable to attend the rescheduled event will be deemed to be a reconfirmation of your order for Tickets or Ticket Packages for the rescheduled event, and you will not be able to claim a refund. If You have already received Your Tickets then You may be asked to return them before a refund can be issued. Refunds will only be made to the person who purchased the Tickets. Where payment was made by a credit card, refund will be made to only the card used during the original purchase. We reserve the right to offer refunds in other forms of payment if required including cash or cheque which would have to be collected from our offices.  Liability for the cancellation or rescheduling of an Event, or for material changes to an Event, will be limited to a refund as set forth in Condition 4.f.
    4. Where tickets are purchased through our website for a third party Promoters event that is cancelled, rescheduled or changed, you will need to contact the third party promoter directly for refunds and be bound by their Terms / Conditions and deadlines. You hereby agree that Haymans Inc. will have no liability to you or any other ticket holder whose tickets were purchased through our website for any losses, damages, death or injury suffered in connection with third party Promoters or Service Providers in connection with this event.
    5. “Force Majeure” means any cause beyond Live Nation’s control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments.  Subject to the provisions of Condition 12, Live Nation will not be liable to You for failure to perform any obligation under the Conditions to the extent that the failure is caused by Force Majeure.
    6. The total refund for a Ticket shall be the price paid to the Agent for the Ticket purchased.  Personal arrangements including travel, subsistence, hospitality or accommodation relating to the Event which have been arranged by You are at Your own risk and Haymans Inc. will not be liable for these expenses.  Neither Haymans Inc nor the Promoter shall be liable for any loss of enjoyment or wasted expenditure in addition to refunding the price of the Ticket.

  5. Recording Of Events

    Typically Promoters have a recording policy which prohibits the recording, transmission or reproduction of any description, account, picture, sound or other aspect of the event. Should you violate the Promoter's rules prohibiting recording of an event you may be ejected and you may be subject to such other actions as the Promoter or the venue may deem appropriate. Often the events themselves, including portions of the audience are recorded. By purchasing a ticket through Haymans Inc. you hereby grant permission to the Promoter and/or venue to utilize your image, likeness, actions or statements in any live or recorded audio, video or other photographic display or other transmission, exhibition, publication or reproduction made of or at the event, regardless of whether or not the recording took place before, during or after the performance. Such permission is granted for recording and transmission in any medium and without further authorization by you or compensation to you.

  6. Ejection From Event By Promoter

    Promoters and venues reserve the right, without any refund to you, to refuse admission to you or eject you if the Promoter or venue management considers your conduct to be obnoxious, vulgar, disorderly, abusive or disturbing or if the Promoter or venue management believe you have failed to comply with the Promoter's or venue's rules. Breach of the terms of the Promoter's or venue's rules and regulations will terminate your right to attend the event and will subject you to ejection from the event without a refund. The Promoter considers the ticket to be a revocable license for admission to an event and admission may be refused and the license cancelled for violation of the Promoter's rules.

  7. Alcoholic Beverages and Prohibited Items

    Our rules and regulations prohibit alcoholic beverages from being brought into the event, illegal drugs, weapons of all types, cameras, recording devices and other items. By purchasing a ticket through our website you understand and agree that your attendance at the event will be subject to the rules and regulations, including being subject to the policy prohibiting certain items and materials. If you attempt to bring prohibited materials into the event the Promoter may seize them and/or may refuse you admission without a refund.

  8. Reselling of Tickets

    Tickets purchased through Haymans Inc. may not be used for the purposes of advertising, promotion, contests or sweepstakes without the written authorization of the Event Promoter. Reselling or “scalping” of tickets at a higher price than you purchased at is not allowed. Any attempt to do this will be grounds for seizure of the ticket and cancellation by the promoter and or venue without compensation.

  9. Personal Belongings

    You must not leave any bags or other items of personal property unattended in the Venue.  Any personal possessions or other items (including without limitation clothing, wallets and mobile telephones), which are found in the Venue, shall be retained by the Venue for a period of 30 days following their discovery.  During this period You may collect any item which belongs to You from the Venue upon reasonable proof of identification and ownership.  If, upon the expiry of 30 days from the date of its discovery, any item has not been collected by You, Live Nation reserves the right to dispose of any such items as it sees fit without any further liability to You (notwithstanding anything else in the Conditions).

  10. Data Protection

    We are committed to protecting the privacy and security of your personal information.

    1. Information we collect: We collect personal information such as your name, email address, phone number, mailing address and non personal such as IP address, browser type, device information and browsing patterns when you Register an Account / place an order or contact us with inquiries.
    2. How we use this information: We use this information to process your orders to provide the products or services you request, to communicate with you about your account, orders and inquiries / to personalise your experience and improve our services and products / to send you marketing communications and primatial offers / to detect and prevent fraud and unauthorised access.
    3. Information Sharing: We may share your personal information with third-party service providers who assist us in operating our website, conducting business, or servicing you. These service providers are contractually obligated to protect your information and only use it for the purposes specified by us. We may also disclose your information in response to legal requirements, enforce our policies, respond to claims that content violates the rights of others, or protect anyone's rights, property, or safety.
    4. Data Security: We take reasonable measures to protect your personal information from unauthorized access, use, or disclosure. However, please be aware that no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.  Your Choices: You can update your account information, unsubscribe from marketing communications, or request the deletion of your account by contacting us using the information provided below.
    5. Children's Privacy: Our website and services are not directed to children under the age of 13, and we do not knowingly collect personal information from children. If you believe that we have collected personal information from a child under 13, please contact us immediately.  Changes to this Privacy Policy: We reserve the right to update or modify this Privacy Policy at any time. Any changes will be effective immediately upon posting the updated Privacy Policy on our website.
    6. Method of Transaction Security: cardholder account data is protected using SSL/TLS during the payment process.

  11. Limitation of Liability

    By purchasing this ticket through our website, you agree to indemnify Haymans Inc. and to hold Haymans Inc. and its oficers, directors, agents, employees, contractors and principals, harmless from any losses, cost, expenses, liability, damages, liabilities, claim or demand, including reasonable attorneys' fees incurred by Haymans Inc., in connection with any third party claim, demand or liability, which claim or loss is based on, related to or arises out of your use of the Site or your purchase of a ticket through the Site, or your attendance at the event for which the ticket was issued except to the extent that the claim or loss was due to the negligent or wrongful conduct of Haymans Inc.

  12. Governing Law

    These Terms shall be governed and construed in accordance with the laws of Barbados regardless of where you may be on the world wide web when you transmit your order through our service.

  13. Changes to Terms

    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
